Terms & Conditions.

These Terms & Conditions ("Terms") establish general terms applicable to services provided by OnCall Home Co. ("OnCall," "we," "our," or "us").
Project-specific estimates, proposals, scopes of work, change orders, invoices, financing documents, and other written agreements may contain additional or different terms. When applicable, those project-specific documents should be read together with these Terms.
1. Estimates and Proposals
Estimates and proposals are based on the conditions, information, measurements, selections, and project requirements reasonably known at the time they are prepared.
Unless otherwise stated in writing, an estimate does not include work or materials outside the written scope.
Verbal discussions do not modify the written scope unless incorporated into an approved written change.
Estimates are valid for the period stated on the estimate. If no period is stated, OnCall reserves the right to revise pricing before acceptance due to changes in material costs, labor availability, project conditions, or other circumstances.
2. Scope of Work
The written scope contained in the accepted estimate, proposal, or agreement defines the work OnCall Home Co. has agreed to perform.
Items not specifically included should not be assumed to be included.
Customers are encouraged to review the complete scope before approving a project and ask questions regarding any item that is unclear.
3. Scheduling
Project dates and estimated durations are provided in good faith but may change because of:
- Weather
- Material availability
- Supplier delays
- Inspection or permit delays
- Unforeseen site conditions
- Customer-requested changes
- Trade availability
- Emergencies
- Events outside OnCall Home Co.'s reasonable control
Unless specifically guaranteed in writing, projected start and completion dates are estimates rather than guarantees.
OnCall will communicate material scheduling changes as reasonably practicable.
4. Property Access
The customer is responsible for providing reasonable access to the work area during scheduled working periods.
This may include access to:
- The property
- Work areas
- Electrical service
- Water
- Driveways or designated parking
- Other utilities reasonably necessary to perform the work
Customers should disclose known access restrictions before work begins.
5. Customer Responsibilities
Unless otherwise included in the written scope, customers are responsible for:
- Removing or securing valuable and fragile personal belongings from work areas
- Providing access to the property
- Keeping children and pets safely away from active work areas
- Identifying known concealed utilities or unusual property conditions
- Obtaining required HOA approvals unless specifically included in OnCall's scope
- Making selections and approvals within requested timeframes
- Providing customer-supplied materials when specified in the proposal
Delays resulting from missing selections, customer-provided materials, access, approvals, or other customer responsibilities may affect the schedule and may result in additional charges when additional mobilization or labor is required.
6. Existing and Concealed Conditions
Construction, remodeling, repair, and maintenance work can reveal conditions that could not reasonably be identified before work began.
Examples include:
- Water damage
- Mold or microbial growth
- Rot
- Insect damage
- Improper previous construction
- Hidden electrical or plumbing conditions
- Structural deficiencies
- Code-related issues
- Damaged framing
- Substrate failure
- Underground conditions
- Concealed utilities
Unless specifically included in the original scope, correction of unforeseen or concealed conditions constitutes additional work and may require a change order.
OnCall Home Co. will communicate significant discovered conditions before proceeding with additional work when reasonably possible.
7. Change Orders and Additional Work
Changes requested after acceptance of a project may affect price and schedule.
Additional work should be documented and approved before being performed whenever reasonably practicable.
Emergency work or work reasonably necessary to protect the property may be handled differently when immediate action is required.
8. Materials and Product Variations
OnCall Home Co. uses materials appropriate to the applicable scope and company standards.
Natural and manufactured products may contain normal variations in color, texture, grain, pattern, shade, dimensions, or appearance.
Paint colors and other finishes may also appear different because of lighting, surrounding materials, substrate conditions, sheen, and application conditions.
Such normal variations are not considered workmanship defects.
9. Customer-Supplied Materials
When a customer supplies materials, fixtures, finishes, equipment, or other products, the customer is responsible for ensuring that the items are:
- Correct
- Complete
- Undamaged
- Compatible with the intended installation
- Available when required
OnCall Home Co. is not responsible for manufacturer defects, missing components, incorrect products, product performance, or warranty coverage for customer-supplied materials.
Additional labor, return trips, or schedule changes caused by customer-supplied materials may result in additional charges.
10. Employees, Vendors, and Trade Partners
OnCall Home Co. may use employees, subcontractors, independent trade partners, suppliers, and specialty vendors to perform or support portions of a project.
All work managed by OnCall remains subject to the applicable OnCall project standards and quality-control process.
11. Permits and Code Requirements
Permits, engineering, inspections, HOA approvals, and similar requirements are included only when specifically identified in the written scope.
If previously unknown requirements are imposed by an authority having jurisdiction after work begins, resulting additional work or cost may require a change order.
12. Payments
Payment terms will be identified in the applicable estimate, proposal, invoice, or project agreement.
Customers agree to make payments according to the stated schedule.
Failure to make required payments may result in suspension of work, postponement of scheduling, collection activity, or other remedies available under the applicable agreement and law.
Any fees associated with particular payment methods will be disclosed where applicable.
13. Deposits
When a deposit is required, scheduling, material ordering, or project commitments may not begin until the required deposit and applicable approvals have been received.
The treatment of deposits following cancellation will be governed by the applicable project agreement and applicable law, including costs or commitments already incurred for the project.
14. Cancellations and Rescheduling
Customers should notify OnCall Home Co. as soon as possible if a project or appointment must be cancelled or rescheduled.
Cancellation or rescheduling charges may apply when OnCall has incurred expenses, ordered materials, reserved specialty trades, committed labor, or otherwise incurred project-specific costs.
Any statutory cancellation rights applicable to a particular transaction remain unaffected by these Terms.
15. Project Photography and Documentation
OnCall Home Co. may photograph or record work areas before, during, and after a project for documentation, quality control, training, warranty administration, vendor coordination, and protection of the customer and company.
Public use of project imagery for marketing, portfolio, website, advertising, or social-media purposes will be governed by the customer's applicable agreement or authorization.
OnCall seeks to avoid displaying identifying information such as addresses, personal documents, family photographs, security information, or other sensitive information in publicly used project imagery.
16. Workmanship Warranty
Eligible work performed by OnCall Home Co. is covered by the workmanship warranty stated in the customer's applicable proposal, agreement, or published warranty terms.
Unless a different warranty is expressly provided in writing, OnCall's standard workmanship warranty is one (1) year from substantial completion.
The workmanship warranty applies to defects caused by OnCall's covered workmanship.
It does not cover conditions resulting from:
- Normal wear and tear
- Abuse, misuse, or neglect
- Lack of maintenance
- Movement, settlement, expansion, or contraction of the structure or substrate
- Water intrusion unrelated to OnCall's covered work
- Existing conditions
- Work performed or modified by others
- Customer-supplied products
- Manufacturer defects
- Acts of nature or casualty
- Conditions outside OnCall Home Co.'s reasonable control
Manufacturer warranties remain subject to the manufacturer's terms.
Additional project-specific warranty provisions may apply.
17. Warranty Service
Customers should notify OnCall Home Co. promptly after discovering a condition believed to be covered by warranty and provide reasonable access for inspection.
OnCall must be given a reasonable opportunity to inspect and, when appropriate, correct covered workmanship before another contractor performs corrective work.
Unauthorized work performed by another party may affect warranty coverage for the affected area.
18. Touch-Ups and Completion
Minor touch-ups and punch-list items are a normal part of many construction and remodeling projects.
When applicable, OnCall may conduct a final walkthrough or provide an opportunity for the customer to identify reasonable workmanship-related touch-ups.
Substantial completion does not require every minor punch-list item to have been completed when the project is otherwise capable of being used for its intended purpose.
19. Existing Property and Adjacent Surfaces
OnCall Home Co. will use reasonable care while working in and around the customer's property.
Construction and repair work may involve unavoidable vibration, dust, noise, temporary disruption, and interaction with existing materials.
OnCall is not responsible for failures or damage caused by pre-existing deterioration, improperly installed existing materials, hidden defects, or conditions that could not reasonably have been anticipated.
20. Cleaning
Unless otherwise stated in the scope, OnCall will perform reasonable job-related cleanup and remove debris generated by our work.
Construction cleaning is not equivalent to professional whole-home or deep cleaning.
Some residual dust may occur during remodeling, drywall, painting, concrete, demolition, or similar work.
21. Color and Finish Matching
Exact matching of existing paint, stain, grout, caulk, flooring, tile, siding, concrete, wood, or other aged materials cannot always be guaranteed.
Weathering, age, ultraviolet exposure, previous applications, manufacturing differences, and existing conditions can affect the final appearance.
22. Limitation to Contracted Work
OnCall Home Co. is responsible for the work specifically included in its contracted scope.
Inspection or performance of work in one area does not constitute an inspection, certification, or warranty of unrelated portions of the property.
23. Third-Party Products and Manufacturer Warranties
Products and equipment supplied by manufacturers may be covered by separate manufacturer warranties.
OnCall Home Co. does not control the terms, duration, approval, or administration of third-party manufacturer warranties.
Where appropriate, we may reasonably assist customers in identifying applicable warranty information.
24. Safety
Customers, occupants, guests, children, and pets should remain outside designated work areas.
Tools, materials, equipment, temporary openings, unfinished surfaces, and active construction areas may present hazards.
Customers agree not to interfere with safety barriers, equipment, or active work.
25. Right to Stop or Suspend Work
OnCall Home Co. may stop or suspend work when reasonably necessary because of unsafe conditions, nonpayment, denied access, customer interference, undisclosed hazardous conditions, severe weather, or other circumstances preventing safe or proper completion of the work.
26. Hazardous Materials
Unless specifically included in writing, OnCall's services do not include testing, remediation, abatement, handling, or removal of regulated hazardous materials such as asbestos, lead-containing materials, or mold requiring specialized remediation.
If suspected hazardous materials are encountered, work in the affected area may be suspended until appropriate evaluation or remediation occurs.
27. Limitation of Liability
To the extent permitted by applicable law, OnCall Home Co. will not be responsible for indirect, incidental, special, exemplary, or consequential damages arising from circumstances outside the scope of our contracted work.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
28. Disputes
We encourage customers to contact OnCall Home Co. promptly with any concern.
Our goal is to inspect the issue, understand the circumstances, and provide a reasonable opportunity to address legitimate concerns before either party pursues further remedies.
Any additional dispute-resolution requirements contained in a signed project agreement will apply to that project.
29. Governing Law
These Terms and services provided by OnCall Home Co. are governed by applicable federal law and the laws of the State of Indiana, without regard to conflict-of-law principles.
30. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
31. Entire Agreement and Project Documents
These Terms are intended to operate together with applicable estimates, proposals, scopes of work, selections, approved change orders, invoices, warranty documents, and other written project agreements.
Project-specific written terms control over inconsistent general website terms to the extent of the inconsistency.
32. Updates to These Terms
OnCall Home Co. may update these Terms periodically.
Changes to website Terms will not retroactively modify an already executed project agreement unless agreed to by the parties or otherwise permitted by law.
